Terms of Service

Last updated November 4, 2026 · All of Us Portraits is a trade name of Cadia First Holdings LLC, California

Please read: these Terms include an agreement to resolve disputes by individual arbitration and a class-action waiver (see "Disputes and arbitration"). You can opt out within 30 days after you first agree to these Terms.

What we do

All of Us Portraits uses artificial intelligence to create a digital portrait from photos you upload, checks it for likeness with an automated system, and delivers digital image and PDF files. Nothing is shipped unless you also order a print of your portrait (see Prints).

Who can use this site

You must be 18 or older to use All of Us Portraits. We make portraits of pets. You may add yourself, and up to one other adult, next to your pets: people in a portrait must be adults 18 or over, and we don't make portraits of children. The service is offered only to U.S. residents. Residents of Illinois and Washington may order portraits of pets only: every subject must be a pet, and the photos must show only those pets, with no person anywhere in them. If you live there, you confirm this on the upload page, and we may cancel and refund an order that doesn't meet it.

Your photos and permissions

You confirm that:

You agree to reimburse us for losses, including reasonable legal fees, that result from these statements being untrue. We don't show customer portraits publicly or in marketing unless every adult pictured gives us separate written permission. Anyone who appears in a portrait may ask us to delete it: see "If you appear in a portrait" in our Privacy Policy.

Consent to process your photos

We process your photos only with the consent you give using the separate checkboxes on the upload page, as described in our Privacy Policy (and, for Washington residents, our Washington Consumer Health Data Privacy Policy). Agreeing to these Terms is not that consent.

AI-generated portraits

Portraits are created with AI. Results vary with the photos provided; clear, well-lit photos give a more accurate likeness. Portraits are artistic interpretations and may differ from reality in details like clothing, setting or small features. Portraits are generated with Google's invisible SynthID watermark where available, and delivered files are labeled as AI-generated in their metadata.

Your rights to the portrait

When you pay, you get a personal, non-commercial license to your portrait: you may print it, frame it, give it as a gift, use it on your own cards and share it online. You may not sell, license or sublicense the portrait or prints of it, use it on merchandise for sale, in advertising or as stock, or use it to train AI models. For commercial use, email us. You may not use it to impersonate or deceive, or for anything unlawful. We may show a portrait as an example only with separate written permission from you and from every adult pictured. We never use images of children in marketing. Because portraits are made with AI, we can't promise that copyright protection applies to them or that similar images couldn't be made by others.

Prices

Previews are free. Prices are one-time payments for digital files, shown before checkout; sales tax is added where it applies. There are no subscriptions. Packages (the Holiday Bundle and the Family Keepsake) include the items listed at checkout. A package's bonus style is made after you order from the same photos and checked for likeness; if no version passes our likeness check, or our image provider declines it, we refund that style (the $12 value, adjusted for any discount you used) and the rest of your order is unaffected.

Gift vouchers

You can buy a gift voucher for one of our packages or Portrait Packs for someone else. It never expires and there are no fees. The person you give it to uses it by uploading their own photos and ordering with the code: they must be 18 or older, accept these Terms and give the same consents as any customer, and the order follows these Terms like any other (including final sale once delivered). A voucher pays for the product it names, at no extra cost even if our price changes later, and can be used once; it has no cash value and can't be used for extras (more pets or people, more styles, gift copies). A Portrait Pack voucher can't be used in Illinois or Washington, where we make portraits of pets only for now; we'll refund it instead. An unused voucher is refunded in full to the buyer on request. If a portrait in an order paid with a voucher is refunded, the money goes back to the card that paid for the voucher. Keep the code private: anyone with it can use it.

Final sale, new versions and refunds

Portraits and the other files we make are digital and made to order from your photos, so sales are final once delivered: there are no refunds, store credit, exchanges or free remakes for a change of mind or because you would prefer a different result. Likeness depends on the photos you upload; before you pay, you confirm you understand that. Before you download, you may buy a new version of a portrait (or your calendar) for $5, paid up front, made from the photos you uploaded (up to 5 per portrait). A new version replaces the previous one, which is deleted. Downloading any full-size file of a portrait (including the holiday card, phone wallpaper or print release, which are made from your main portrait) ends new versions for it, and they close 7 days after each item is ready. We refund automatically when we can't deliver, as listed in our Refund Policy, which is part of these Terms.

Prints

When prints are offered, you can add one to a pet portrait order at checkout or on the thank-you page right after you pay, or order your delivered portrait printed from your portrait page (for example on canvas, as a framed print, a mug or a blanket). Prints are made to order by our print partner and shipped by standard U.S. shipping within the United States (to Illinois and Washington, only prints of pet-only portraits). Prices, shipping and sales tax are shown before you pay. A print bought with your portrait is printed from your finished portrait as soon as that portrait is delivered (after it passes our likeness check), and that portrait is then final: new versions aren't available for it once its print is made. If we can't deliver the portrait, a print bought with it is refunded in full, including shipping. Production and delivery times are estimates, not promises, including any Christmas order-by date we show; we're not responsible for carrier delays, but we'll help you track a late package. Any other print shows your portrait as it was when you ordered the print. Because each print is made just for you, there are no returns, refunds or exchanges for a change of mind. If a print arrives damaged, misprinted or defective, tell us within 30 days of delivery (for a package lost in transit, within 30 days of its estimated delivery date), with a photo where you can, and we'll reprint it or refund it. If an address you gave us is wrong or incomplete, we'll help, but reshipping costs are yours. You may send prints to other people as gifts; you confirm you may give us their name and address for that delivery. Your personal license above covers the prints we make for you.

Gift copies for another home

At checkout you can add a gift copy for another household ($9 each, up to 3). We email the person you name their own download page with the same portrait files as your order (each portrait style, the phone wallpaper and the print release, but not your card or calendar), plus your note, either as soon as your portrait is ready or on the morning of the day you pick (Pacific time). Their page shows the current version of each file, so if you buy a new version, they get it too; their downloads don't end your new versions. Their page stays available as long as your order's files do (12 months after delivery) and closes if your order is refunded or deleted. A gift copy is part of your order and, like the rest of it, a final sale; if your whole order is refunded, the gift copies are refunded with it (and any not yet sent are cancelled). You confirm you may give us the recipient's name and email address for this one delivery. Your personal license above extends to the recipient's household for the gift copy.

What we won't make

We refuse requests involving nudity or sexual content, violence, hate, real public figures, any image of a minor, or anything meant to deceive. We may cancel and refund any order that breaks these rules.

File availability

Download links work for 12 months. Please save your files.

Limitation of liability

To the extent the law allows, our total liability to you for any claim relating to the service is limited to the greater of (a) the amount you paid for the order the claim relates to, or (b) $100. We're not liable for indirect or consequential losses, such as lost profits. None of this limits liability that can't be limited by law, including:

Disputes and arbitration

Please read this carefully. It affects how disputes are resolved. You can opt out (see "Opting out").

  1. Talk to us first. Before starting any claim, send a notice to [email protected] with your name, the email you used, a description of the problem and what you want. We'll do the same before bringing any claim against you. We'll both try in good faith to resolve it within 30 days. Statutes of limitations and filing deadlines are paused during those 30 days.
  2. Individual arbitration. If we can't resolve it, you and we agree to resolve any dispute arising out of or relating to these Terms or the service by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, which are available at adr.org. The Federal Arbitration Act governs this section. A single arbitrator will decide the dispute and can award the same individual relief a court could. The hearing will be held by video or phone, or in person in the county where you live, whichever you choose.
  3. Exceptions. Either of us may instead bring an individual claim in small-claims court. Either of us may go to court to stop infringement or misuse of intellectual property.
  4. Fees. Your share of AAA fees is limited to the consumer filing fee in the AAA's Consumer Fee Schedule. If you can't afford it, we'll pay it at your request. We pay all other AAA filing, administration and arbitrator fees, on time as the law requires, including within the deadlines of California Code of Civil Procedure §§1281.97–1281.98. We won't seek our attorneys' fees from you unless the arbitrator finds your claim frivolous.
  5. No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine more than one person's claims, except as allowed under "Mass filings" below.
  6. Mass filings. If 25 or more similar arbitration demands are filed against us or by us by, or with the help of, the same or coordinated counsel or organization, the AAA's Mass Arbitration Supplementary Rules will apply as the AAA administers them. Statutes of limitations and filing deadlines are paused for every demand while this process is pending.
  7. Public injunctive relief. Nothing in these Terms waives any right you have to seek public injunctive relief where the law doesn't allow that right to be waived. A court, not an arbitrator, will decide any request for public injunctive relief, after any individual claims are arbitrated. The court case will be paused until then.
  8. Opting out. You can opt out of this "Disputes and arbitration" section (except "Governing law and courts", which still applies) by emailing [email protected], with your name, the email you used and the words "arbitration opt-out", within 30 days after you first agree to these Terms. Opting out won't affect anything else about your use of the service.
  9. Changes. If we change this section, the change won't apply to any dispute you or we have already raised in a notice. We'll email you any change to this section, and you can reject it by emailing us within 30 days, in which case the version you last accepted continues to apply.
  10. If part of this section is unenforceable. If the class-action waiver in "No class actions" above is found unenforceable for a claim, that claim (and only that claim) will be decided in court, not arbitration, and it may not proceed as a class arbitration. If any other part of this section is found unenforceable, the rest still applies.
  11. Governing law and courts. These Terms are governed by California law, except where the law of your home state gives you greater protection that can't be waived. Any claim that isn't arbitrated will be brought in the state or federal courts of Alameda County, California, unless the law entitles you to sue where you live.

General

If any part of these Terms is found unenforceable, the rest remains in effect. If we change these Terms, we'll update the date at the top of this page; changes apply to orders placed after that date, except as described in "Changes" under Disputes and arbitration.
